The short answer

A final notice before you file shows the other party had a documented chance to resolve the matter. Send it Certified with electronic Return Receipt, $14.99 all-in: USPS records when it was mailed and when it was signed for. Preview the exact pages free. This template is not legal advice.

This is the letter you send after a demand letter went unanswered — one last, plainly stated notice that you intend to file suit if the deadline passes. It sometimes prompts settlement on its own, because now it is clear this is genuinely escalating.

Why courts and judges like seeing it

A documented final notice shows you gave the other side every reasonable chance before filing. That matters in small claims court, where judges often ask directly whether you tried to resolve things first.

How it works

  • Open the template, reference your prior demand and set a final deadline.
  • Pay $14.99 (Certified + Return Receipt) — mailed the next business day.
  • Keep the delivery record; bring it with you if you file.

This template is a tool, not legal advice — for anything beyond a straightforward small claims matter, an attorney-reviewed letter carries more weight.

Questions before you send

Why not go to the post office myself?

You can, and if your time is free it costs less. USPS charges the same fees whoever hands the letter over; paperplane does not replace the post office, it replaces the trip. The mailing record comes from USPS, not from us. $12.99 covers the printing, the envelope, PS Form 3800, a USPS address check before you pay and a handoff the next business day. For a letter you already know how to send, the counter is a fine choice.

What if they refuse the letter?

USPS tracking records what happened to it, including refused or unclaimed. You still have the mailing record. Rules on what that means vary, so check with your court or an attorney if a deadline depends on it.

If something goes wrong, do I pay?

If we cannot mail the letter, the hold on your card is released and you are not charged. If a letter fails after your card is charged, you are refunded automatically and in full.

Is this the same as a demand letter?

It is a firmer, final version — usually sent after an earlier demand letter went unanswered, stating plainly that you intend to file suit if the deadline passes. Some courts and judges view a documented final notice favorably; it shows you gave the other side every chance.

Do I have to send this before suing?

Not always required, but it is common practice, and some contracts or statutes do require it. It also sometimes prompts settlement, since the other side now sees this is genuinely escalating.

Is this legal advice?

No — it is a template, not legal advice. For anything beyond a straightforward small claims matter, an attorney-reviewed letter carries more weight.
